Delay applying for a DoLS | QCS

Dear Sheila,

I have read what you have said about applying for a DoLS for residents who cannot leave the home on their own but our local authority are asking care homes here to delay applying for a DoLS. What should I do?

Dear Eric,

The law is clear. It places the responsibility on you to apply for an authorisation for anyone you believe may be being deprived of their liberty. It does not place any responsibility on the local authority for the length of time it may take to deal with the application.

Therefore my advice remains the same, you must apply at the earliest opportunity, I am sure your Local Authority will understand.
