The Restraint Policy and Procedure has been extensively updated with additional information regarding the Mental Capacity Act and Deprivation of Liberty.
This policy has been amended to reflect the requirements of the Mental Capacity Act 2005, which regards decisions to be made as specific, so that capacity should be tested for each decision to be made, including whether to move to a care home in the first instance. The policy has also been changed to reflect the introduction of pension credits and the nature of financial assessments conducted by the local authority with relation to new regulations under the Care Act 2014.

This policy and procedure has been changed to reflect the law on Deprivation of Liberty regarding service users who might go missing, and to reflect guidance given to police forces regarding responses to missing vulnerable adults.
The procedure has been expanded to include further information on rights under the Agency Workers Regulations.
This policy has been revised to incorporate new safeguarding statutory guidance which accompanies the Care Act 2014, and guidance from the Chief Coroner following the Coroners and Justice Act 2009.
