Deprivation of Liberty Safeguards Policy and Procedure #4

The Deprivation of Liberty Safeguards protect the rights of the most vulnerable adult Individuals, those who might be deprived of their liberty, in order to give them necessary care or treatment.

The Deprivation of Liberty Safeguards only apply to people aged 18 or over who are in care homes or hospitals to be given essential care or treatment but lack the capacity to consent to the arrangements for this. Other settings (such as supported living or shared lives) providing services to people aged 16 and over, who lack capacity to consent to arrangements for their care or treatment, where those arrangements amount to a deprivation of liberty, must apply (through the commissioner of the service) to the Court of Protection for authorisation.

Correct and lawful practice and recording are essential to protect the rights of the Individuals and to protect the providers from liability.
