Deprivation of Liberty Safeguards Policy and Procedure
This policy has been converted to the new QCS format. The Deprivation of Liberty Safeguards (DoLS) protect the rights of the most vulnerable adult Individuals, those who might be deprived of their liberty in order to give them the necessary care or treatment. The DoLS only apply to people aged 18 or over who are in care homes or hospitals to be given essential care or treatment but lack capacity to consent to the arrangements for this when those arrangements amount to a deprivation of their liberty. Other settings (such as supported living or shared lives) providing services to people aged 16 and over, who lack capacity to consent to arrangements for their care or treatment, where those arrangements amount to a deprivation of liberty, must apply (through the Commissioner of the service) to the Court of Protection for authorisation. Correct and lawful practice and recording are essential, to protect the rights of the users of services and to protect the providers from liability.
