During this webinar our experts will explore a brief guide to understanding Transfer of Undertakings (Protection of Employment) Regulations or “TUPE” in the social care setting.

The session is designed to help businesses understand when TUPE may be relevant for them (usually where there is a tendering process or change in contract providers), the effect of TUPE, as well as guidance on the key steps that employers will need to comply with when TUPE applies.

The discussion will cover:

  • TUPE can apply when businesses are changing contract providers or tendering for the supply of services
  • The employment of employees who provide services under the contract transfer automatically to the new contractor
  • Employers have obligations to inform and consult with employees on the transfer and any proposed measures

Chris King, Senior Associate Solicitor at AfterAthena

Chris is a senior associate solicitor in the employment team at AfterAthena. Chris has worked with QCS for around 8 years and has some considerable experience in advising on employment law issues in the care sector. He handles a range of general Employment and HR matters for employers from day-to-day Employment Law and HR advice to complex TUPE and collective redundancy matters. Chris has carried out work for clients ranging from SMEs through to large Multinationals and PLCs, across a wide range of sectors. In addition to his experience in general HR and Employment Law advice, Chris has experience in negotiation of settlement agreements, employment support work on mergers and acquisitions and disciplinary and capability dismissals.

Olivia Riley, Solicitor at AfterAthena

Olivia is a solicitor with the AfterAthena employment department based across the Preston and East Lancashire offices. She qualified as a solicitor in 2019 with a regional law firm, prior to joining AfterAthena and the Napthens Group in October 2022. Since joining AfterAthena, Olivia has worked closely with a number of clients in the health and social care sector. Olivia has developed strong relationships with business owners and managers through her understanding of the key issues facing the care industry at this time, including difficulties with recruitment and retention, meaning that many businesses are looking outside of the UK for employees (which brings its own set of challenges), discipline and zero hours working arrangements. As well as drafting appropriate contracts, policies and procedures, Olivia also provides practical day-to-day support to our health and social care industry clients in relation to routine people management issues such as sickness absences, disciplinaries and grievances procedures. Olivia works hard to get to know clients and their businesses in order to provide a swift service, focused on delivering risk-based advice in order to achieve commercial outcomes.
